City Attorney Releases Opinion Regarding Question about Prop. 401

At the June 29 Study Session Regarding the Development Agreement with Arizona Eco Development (AED), Council heard comments from some citizens which prompted questions from Council and the public about whether the development agreement would trigger Proposition 401.

City Attorney Jon Paladini has provided a legal opinion for Council consideration, indicating that the agreement with AED would not trigger Prop. 401. Attached is a summary of the legal opinion and the Proposition 401 language.
